During our first session, there have been some situations in which a character could conceivably appear in a scene even if presence wasn't stated before; in a situation like those, what happens? Who decides?

The GM decides.
As GM, usually I go with whatever the player wants, but occasionally I have an opinion on the matter myself, in which case I go with what I want.
